Information on submitting a report under Act No. 171/2023 Coll., on the protection of whistleblowers

The internal reporting system of Mo.one a.s. A secure and confidential channel for reporting possible unlawful conduct.

1. Introductory provisions

At Mo.one a.s. („Mo.one“) we build on an environment founded on trust, transparency and ethical conduct. We believe that open communication is the key to maintaining these values and to protecting our company and our clients. That is why we are introducing an internal reporting system. Its purpose is to provide a secure and confidential channel for anyone who has reasonable suspicion of possible unlawful conduct connected with the activities of Mo.one. This document sets out the rules for submitting and handling reports in line with Act No. 171/2023 Coll., on the protection of whistleblowers (the „Act“), and guarantees every whistleblower the protection the Act affords them.

2. Who can submit a report?

In line with Section 9(2) of the Act, Mo.one defines the group of persons entitled to submit a report through the internal reporting system. The system is intended for persons who perform or have performed work or other similar activity for Mo.one as defined in Section 2(3)(a), (b), (h) and (i) of the Act.

Reports may therefore be submitted in particular by:

  • our employees, whether under an employment contract or an agreement to perform work;
  • members of the Board of Directors and other bodies of Mo.one;
  • persons exercising rights connected with a holding in Mo.one.

In line with its entitlement under the Act, Mo.one excludes the acceptance of reports from other persons performing activity for Mo.one under Section 2(3)(c) to (g) and (j) of the Act.

Persons not covered by the internal reporting system continue to have the full right to bring their report to the external reporting system of the Ministry of Justice.

3. What can a report be about?

A report must concern information about possible unlawful conduct that has occurred or is to occur at Mo.one and that falls into one of the following categories:

  • It bears the marks of a criminal offence.
  • It bears the marks of an administrative offence for which the law sets a fine with an upper limit of at least 100 000 Kč.
  • It breaches the Whistleblower Protection Act.
  • It breaches another legal regulation or a regulation of the European Union in the areas defined by the Act, such as financial services, consumer protection, personal data protection or the security of networks and information systems.

A report should contain information that is as specific as possible so that it can be properly assessed. Anonymous reports, which are not covered by the protection of the Act, may be investigated by Mo.one if they contain enough verifiable information.

4. How and to whom to submit a report?

A. Internal channels of Mo.one

To ensure maximum impartiality and expertise, Mo.one has entrusted the receipt and assessment of reports to an external, independent person (the „person of trust“).

A report can be submitted to the person of trust in one of the following ways:

  • By e-mail: by sending a message to the contact e-mail above, which is intended solely for this purpose.
  • By telephone: by calling the telephone number above.
  • In writing: by sending a letter to the company's registered office: Mo.one a.s., Palackého třída 3048/124, Královo Pole, 612 00 Brno. The envelope must be visibly marked „FOR THE ATTENTION OF THE PERSON OF TRUST - DO NOT OPEN“, to make sure that only the person of trust opens it.
  • In person: by prior arrangement with the person of trust by telephone or e-mail. A meeting will be made possible within a reasonable period, at the latest within 10 days of your request.

Important notice in the event of a conflict of interest

If your report concerns the person of trust directly (Mgr. et Mgr. Klára Svobodová), please submit it by e-mail to the head of the Legal + Compliance Department of Mo.one. Contact e-mail: jschweigl@Mo.one.eu, or in writing to the company's registered office, visibly marked „FOR THE ATTENTION OF THE HEAD OF THE LEGAL + COMPLIANCE DEPARTMENT“.

B. External channels

A whistleblower also has the right to submit a report meeting the requirements of the Act to the external reporting system of the Ministry of Justice. A breach of obligations under Act No. 253/2008 Coll., on certain measures against the legalisation of proceeds of crime and the financing of terrorism, as amended (Section 34a), can be reported to the Financial Analytical Office at reditel@fau.mfcr.cz.
